Rail Dispute Moves to Arbitration

The federal government has ordered an end to the railway stoppage and sent the labour disputes for final arbitration.


Less than 17 hours after the lockout began, Labour Minister Steve MacKinnon announced he's using his powers as labour minister to step in.


Section 107 of the Canada Labour Code allows the government to refer a labour dispute to the Canada Industrial Relations Board (CIRB) to find a solution. MacKinnon said he's directed the board to settle the outstanding terms of the collective agreements and impose final binding arbitration.

 

The Labour Minister has also directed the board to extend the term of the current collective agreements until new agreements have been signed, and for operations on both railways to resume soonest.

 

As CN awaits the formal order from the CIRB, the Company has proactively decided to end its lockout and immediately initiate its recovery plan to get goods moving again.

 

CPKC will follow the order of the CIRB once it executes the Minister’s direction.

 

Both carriers are preparing for the safe and orderly resumption of the rail networks.

 

Further details on the scheduling for resumption of services will be provided once the CIRB has issued its order however the Labour Minister has suggested operations could resume “within days”.
